Mit der Nutzung von Roughly Calories („die App“) erklärst du dich mit diesen Bedingungen einverstanden. Die App wird von Rene Scheucher – Nexus RS („wir“, „uns“) bereitgestellt.

1. Was die App tut

Roughly schätzt Kalorien und Nährwerte deiner Mahlzeiten – aus einem Foto, einer gesprochenen oder getippten Beschreibung, einem Barcode oder der Produktsuche – und führt dein Tagesprotokoll. Die App ist für den persönlichen, nicht-kommerziellen Gebrauch gedacht.

2. Haftungsausschluss – wichtiger Hinweis

Der Name ist Programm: Die App schätzt grob. Schätzungen aus Fotos und Beschreibungen weichen typischerweise um ein Fünftel bis ein Viertel vom tatsächlichen Wert ab, im Einzelfall auch mehr. Sie sind Anhaltspunkte, keine Messwerte.

Die App ist keine medizinische Beratung, keine Ernährungsberatung und kein Medizinprodukt. Bei Erkrankungen, Schwangerschaft, Essstörungen oder besonderen Ernährungsanforderungen wende dich an eine Ärztin, einen Arzt oder eine Ernährungsfachkraft.
Produktdaten stammen aus Open Food Facts, einer von Freiwilligen gepflegten Datenbank. Sie können unvollständig oder fehlerhaft sein – prüfe im Zweifel die Verpackung.
Das berechnete Tagesziel ist eine Näherung aus Gewicht, Zielrichtung und Aktivität. Es ersetzt keine individuelle Beurteilung.

Wir übernehmen keine Haftung für gesundheitliche oder sonstige Folgen, die aus der Verwendung der Schätzungen oder Zielwerte entstehen. Die Nutzung erfolgt auf eigenes Risiko. Zwingende gesetzliche Haftung, etwa für Vorsatz oder grobe Fahrlässigkeit, bleibt unberührt.

3. KI-Schätzungen und Kontingent

Schätzungen aus Foto, Sprache und Text laufen über ein KI-Modell eines Drittanbieters und sind kontingentiert: ohne Abo 10 KI-Einträge pro Tag, mit Premium 50. Ein Eintrag ist eine Mahlzeit; das Nachjustieren der Portionsgröße kostet keinen weiteren. Je Mahlzeit ist die Zahl der Schätzversuche begrenzt. Manuelle Eingabe, Barcode-Scan und Produktsuche sind unbegrenzt und laufen ohne KI.

Wir können das verwendete Modell, die Grenzen und die Art der Schätzung ändern, wenn sich Kosten, Qualität oder Verfügbarkeit ändern. Wesentliche Änderungen kündigen wir in der App an.

4. Abonnement und automatische Verlängerung

Roughly bietet ein optionales Abonnement („Premium“) an, das das Tageskontingent erhöht. Der Kauf wird über Apples App Store abgewickelt; ergänzend gilt die Standard-EULA von Apple.

Preise: 2,99 € pro Monat oder 29,99 € pro Jahr. Die im App Store angezeigten Preise sind maßgeblich; sie können sich nach Land und Währung unterscheiden.
Kostenlose Probewoche: Das Jahresabo beginnt mit 7 Tagen kostenlos. Danach wird es automatisch kostenpflichtig, sofern du nicht vorher kündigst.
Automatische Verlängerung: Das Abo verlängert sich automatisch, wenn es nicht mindestens 24 Stunden vor Ablauf der laufenden Periode gekündigt wird.
Zahlung: Die Abrechnung erfolgt über dein Apple-Konto. Wir sehen keine Zahlungsdaten.
Kündigung: Jederzeit in den iOS-Einstellungen unter Apple-Konto → Abonnements. Der Zugang bleibt bis zum Ende der bezahlten Periode.
Erstattungen richten sich nach den Richtlinien von Apple.
Wiederherstellung: Das Abo lässt sich auf allen Geräten mit demselben Apple-Konto über „Käufe wiederherstellen“ in den Einstellungen aktivieren.

5. Geistiges Eigentum

Design, Code, Texte und Grafiken der App sind urheberrechtlich geschützt. Produktdaten aus Open Food Facts stehen unter der Open Database License (ODbL); die Nutzung in der App erfolgt nach deren Bedingungen.

6. Verfügbarkeit

Wir bemühen uns um einen zuverlässigen Betrieb, garantieren aber keine ununterbrochene Verfügbarkeit. KI-Schätzungen hängen von Diensten Dritter ab und können vorübergehend ausfallen. Manuelle Eingabe und dein Tagesprotokoll funktionieren auch ohne Verbindung.

7. Änderungen

Wir können diese Bedingungen anpassen. Die aktuelle Fassung steht stets unter dieser Adresse; bei wesentlichen Änderungen informieren wir über ein App-Update.

8. Anwendbares Recht

Es gilt österreichisches Recht. Bist du Verbraucher, bleiben die zwingenden Verbraucherschutzvorschriften deines Wohnsitzstaates unberührt.

By using Roughly Calories (“the App”) you agree to these terms. The App is provided by Rene Scheucher – Nexus RS (“we”, “us”).

1. What the App does

Roughly estimates the calories and nutrients of your meals – from a photo, a spoken or typed description, a barcode or the product search – and keeps your daily log. The App is intended for personal, non-commercial use.

2. Disclaimer – please read

The name says it: the App estimates roughly. Estimates from photos and descriptions typically deviate by a fifth to a quarter from the true value, sometimes more. They are pointers, not measurements.

The App is not medical advice, not dietary advice and not a medical device. If you have a medical condition, are pregnant, have an eating disorder or special dietary needs, consult a doctor or a qualified nutritionist.
Product data comes from Open Food Facts, a database maintained by volunteers. It can be incomplete or wrong – when in doubt, check the packaging.
The calculated daily goal is an approximation from weight, goal direction and activity. It does not replace an individual assessment.

We accept no liability for health-related or other consequences arising from the use of the estimates or goals. Use is at your own risk. Mandatory statutory liability, for instance for intent or gross negligence, remains unaffected.

3. AI estimates and daily limit

Estimates from photo, speech and text run through a third-party AI model and are limited: 10 AI entries per day without a subscription, 50 with Premium. One entry is one meal; adjusting the portion size does not cost another. The number of estimate attempts per meal is capped. Manual entry, barcode scanning and product search are unlimited and do not use AI.

We may change the model, the limits and the way estimates are produced if cost, quality or availability change. We will announce material changes in the App.

4. Subscription and automatic renewal

Roughly offers an optional subscription (“Premium”) that raises the daily limit. Purchases are processed through Apple’s App Store; Apple’s Standard EULA applies in addition to these terms.

Prices: €2.99 per month or €29.99 per year. The prices shown in the App Store are binding and may differ by country and currency.
Free trial: The yearly plan starts with 7 days free. It then becomes a paid subscription unless you cancel before the trial ends.
Automatic renewal: The subscription renews automatically unless cancelled at least 24 hours before the end of the current period.
Payment: Billed through your Apple account. We never see payment details.
Cancellation: Any time in iOS Settings under Apple Account → Subscriptions. Access continues until the end of the paid period.
Refunds are governed by Apple’s policies.
Restoring: The subscription can be activated on all devices using the same Apple account via “Restore purchases” in Settings.

5. Intellectual property

The App’s design, code, texts and graphics are protected by copyright. Product data from Open Food Facts is licensed under the Open Database License (ODbL) and is used in the App under its terms.

6. Availability

We aim for reliable operation but do not guarantee uninterrupted availability. AI estimates depend on third-party services and may be temporarily unavailable. Manual entry and your daily log work without a connection.

7. Changes

We may update these terms. The current version is always available at this address; for material changes we will notify you through an App update.

8. Governing law

Austrian law applies. If you are a consumer, the mandatory consumer protection rules of your country of residence remain unaffected.
